We work in what we call an “argument tracker.”
An argument tracker is a template we use to catalogue the issues, arguments, and subarguments in a case
and to distill them to their basic units – premise, evidence, conclusion.
All of our case analysis, brief writing, and witness outlines are created and refined in an argument tracker.
The argument tracker allows us to:
- determine the foundational facts that a jury is likely to believe are true.
- frame a question for the jury based on that foundation that will maximize the probability of victory.
- locate the holes or weak spots in our case that must be eliminated.
Using the argument tracker we can quickly create a deep and accurate analysis of a set of facts and law,
and synthesize it in a way that maximizes the chances of victory.
