One of the tools we use to conduct research at all three levels is the mock jury study using a live audience in a
controlled setting. We typically conduct two mock jury studies for each case.
In such a study, 10 to 24 mock jurors
recruited from an appropriate jury pool deliberate on the key issues after viewing live presentations of each side’s
case as well as key witnesses on videotape.
We do the first jury study about 90 days after commencing a case and use
the results to guide further discovery and investigation and as a factor in establishing the settlement value of the
case. We conduct a second jury study 30 days before trial.
